Bankruptcy Reorganization of Real Estate: In several Chapter 11 proceedings spanning a period of over five (5) years, through lender liability, real estate valuation and other litigation, as well as the confirmation of plans of reorganization, the Firm successfully restructured several real estate projects for our real estate developer client, involving properties worth several hundreds of millions of dollars.
Residential Development Dispute: For our real estate developer client, the Firm successfully defeated a mandamus and writ of mandate petition brought by adjacent homeowners to halt construction of a single family development and obtained a judgment upholding the issuance of permits.
Class Action case against a Water District: On behalf of a class of residential water users who had been overcharged for water usage in a manner that was illegal under Proposition 218, the Firm forced the water district to establish a fund of over $2 million out of which refunds were paid to customers who filed claims.
Land Use and Entitlements Dispute Involving Affordable Housing: After litigation that went all the way to the California Supreme Court, on behalf of the largest private developer of apartments in Los Angeles County, the Firm obtained and enforced a judgment against the City of Los Angeles setting aside the City’s inclusionary housing ordinance as being in violation of the Costa Hawkins Act, resulting in the elimination of fee of several million dollars that was illegally imposed on an apartment project in downtown Los Angeles.
Landlord-Tenant and Fraud Dispute: Obtained a high seven figure judgment for our landlord client against a tenant.
Breach of Contract: Secured a high seven figure judgment for our business-owner client.
Real Estate Investment Fraud: By bringing lawsuits in both the state and bankruptcy courts, the Frim obtained total recoveries for a group of creditors and our client of about $6 million.
Real Estate Fraud: Obtained a judgment for an investment advisor setting aside a fraudulent deed of trust with a face value in excess of $2 million.
Real Estate Ownership Dispute: Obtained an award granting ownership to a real estate developer of several parcels of property from the original Tarzana Ranch of Edgar Rice Burroughs valued in excess of $7 million.
Business and Real Property Ownership Dispute: Obtained a winning jury verdict for our business-owner client, including the award of over $2 million in damages and the turnover to our client of a $14 million cold storage processing facility.
Construction Defect: Recovered for our client over $15 million dollars in a complex high-end residential construction defect case.
Real Estate Non-Disclosure and Fraud: Successfully defended our real estate developer client against a civil suit involving millions of dollars in claimed damages relating to the purchase and sale of a large apartment complex.
Residential Construction Defect: After heavy litigation involving an iconic estate property, the Firm obtained several millions of dollars for our client from the general contractor and subcontractors.
Medical Practice Dispute: After extensive litigation involving claims for breach of fiduciary duty and breach of contract, the Firm obtain a very advantageous settlement for our client doctors who had purchased a medical practice.
Real Estate Partition Lawsuit: Successfully obtained a judgment partitioning numerous real estate parcels worth several millions of dollars.
